The TSC Bonding Form is a legal document that establishes a binding agreement between the teacher (the Obligor), the TSC, and two sureties.

This agreement ensures that the teacher complies with the conditions set out in the form during and after their scholarship or study leave. Let’s break down the essential sections of the form:

Parties to the Agreement: The form identifies the Obligor (the teacher), the first surety, and the second surety, along with their full names, TSC numbers, and ID numbers.

Bond Amount: The form specifies that the Obligor, the first surety, and the second surety are jointly and severally bound to the TSC in an amount equivalent to the value of the scholarship plus the salaries and allowances paid during the scholarship or study leave. This amount serves as a guarantee for the TSC.

Conditions of the Bond: The bond’s obligations are outlined, including:

  • The obligation to complete the course of study for which the scholarship.
  • Following the rules governing scholarship awards.
  • Returning to Kenya as required after completing the course, unless prevented by sickness or other valid circumstances.
  • Rejoining or entering the TSC establishment if called upon to do so by the Minister/Chief Executive, based on the competency gained from the course of instruction.
  • Undertaking engagements directed by the Minister if not called upon to rejoin the TSC establishment.

Termination of Bond: The Commission Secretary has the discretion to release the Obligor from the bond’s obligations at any time before the agreed-upon period expires.

However, in case of a breach of conditions, the bond remains in force, and the specified amount becomes payable to the TSC as liquidated damages, not as a penalty.

Agreement by the Obligor and the Government: The form confirms the agreement between the Obligor and the Government of Kenya regarding the terms of employment with the TSC.

Unless the TSC terminates the bond, these terms take precedence over later or subsequent terms of appointment.
