School Leaver Receives Life Imprisonment for Defiling 11-year-old Pupil
Monday, a Kangema court sentenced a 20-year-old male to life in prison after finding him guilty of molesting an 11-year-old girl.
Senior Principal Magistrate Peter Kiama imposed the sentence on Dancan Thiongo Kariuki after the court established he defiled the sixth-grade student multiple times between January and June 13, 2022, at Nyakahura Sub location in Kangema Sub County.
The girl testified in her deposition that the defendant used to visit their residence, where she resided with her grandmother and uncle.
She mentioned that Kariuki was a classmate with her uncle at a local secondary school.
The court heard that the defendant was a fourth-year student at the time of the offense.
The student told the court that the accused began seducing her in January 2022 and forced her to view pornographic videos at their residence.
“In June 13, 2022, I was with my aunt, who had visited us. We went to give our goats water, when my aunt left me behind and went back in the house, the accused came and found me, forced me to lie down, and then defiled me near the goats’ den,” the girl narrated before the court.
The student went on to say that Kariuki violated her on multiple occasions. “The other times he used the house of my uncle to defile me,” she claimed.
The girl stated that she was compelled to notify her classmate, who advised her to inform their teacher.
The court was informed that the teacher contacted the girl’s grandmother and Nairobi-based mother.
The girl was brought to Kangema hospital for a medical examination, where she was prescribed medications to prevent her from contracting sexually transmitted diseases.
The girl was defiled, according to the medical report submitted to the court, but tests for venereal disease and pregnancy were negative.
In his defense, Kariuki stated that he was in school on the dates in question, implying that the girl’s family had lied about the alleged molestations.
He claimed that the girl mistook him for someone else, but the court ruled that he was positively identified and was a neighbor of the girl’s household.
He informed the court that, after completing secondary school, he planned to enroll in college by mid-year.
The magistrate rejected the defendant’s defense in its entirety, stating that it does not affect the prosecution’s evidence.
Kariuki was given fourteen days to file an appeal if he was unhappy with the verdict.
