The Ministry of Education has announced its intentions to review policies that overlap with other mandates.

The measures extend from basic education to higher education, according to a study by the education sector working group.

The TSC Act of 2012 and the Basic Education Act of 2013 are two of the laws that are in effect.

The University Act of 2012, the TVET Act of 2013, and the KNQA Act of 2014 all contradict one another in the field of higher education.

“Review and harmonise various Acts that at times contradicts and conflict with each other and impact negatively on service delivery,” the report reads.

Primary school teachers requested for a review of laws that overlapped with one another when delivering presentations to the education team.

There is duplication of quality assurance standard functions in TSC and the ministry, according to Kenya National Union of Teachers Secretary General Collins Oyuu.

The mandate of the TSC and ministry is clearly stated in their respective charters, according to Oyuu.

“However both TSC and ministry have established an Inspectorate Department/ Division thus duplicating roles,” Oyuu said.

The clash between the TSC Act and the Basic Education Act is demonstrated by this recommendation.

“Quality Assurance and Standards should be undertaken by an external independent body for objectivity,” he said.

In designing content for Teachers’ Professional Development, he also mentioned a clash of mandates.

Every five years, TPD works to assist teachers in renewing their professional credentials.

“Designing and dictating the content for the TPD curriculum is a mandate of KICD,” he said.

Teachers will now be obliged to complete five years of in-service professional training and renew their certificates.

Six modules, each lasting five years, make up the professional development program, which will last 30 years.
