Man Sentenced To Life Imprisonment For Impregnating Schoolgirl, Says DNA Testing is Idol Worship.
A man named Joseph Mureithi Gathure was found guilty of committing incest and impregnating his 15-year-old niece in the Lanet area of Nakuru County on December 16, 2020.
The court sentenced him to life imprisonment, as requested by the prosecutor, under Section 20 (1) of the Sexual Offenses Act because the victim was underage.
During the hearing, Mureithi claimed that he had been taking care of the minor and paying her school fees, so he could not have committed such an act.
However, the prosecution presented several witnesses who testified against him and implicated him in the offense.
The court relied on the evidence and medical reports presented in court, including DNA profile samples generated by the Government Chemist, which linked the accused to be the biological father of the child.
“DNA profile samples generated as per the report of the Government Chemist dated January 30, 2023 linked the accused with a 99.9 per cent chance to be the biological father to the child borne out of the offense,“ said the magistrate
The court concluded that the accused was the perpetrator of the offense and took advantage of the underage girl repeatedly every time she went to collect school fees.
The magistrate stated that the offense was grave and deserved no mercy.
On January 24, Gathure caused a drama in court when he opposed a directive by the court to have his DNA samples collected from him to determine the paternity of the child.
He refused to allow his blood sample to be taken, describing it as an act of idol worship. However, the court rejected his claims and ordered him to undergo the DNA test.
“The offense is grave and deserves no mercy, and therefore this court sentences him to life imprisonment,” said the Magistrate.
