KNEC Grants Students 30-Day Window to Appeal for Cancelled Exams

In response to the cancellation of national exams, the Kenya National Examinations Council (KNEC) has introduced an opportunity for affected students to appeal. The provision is outlined in the Kenya National Examinations Council (Amendment) Bill, 2024, crafted by the Presidential Working Party on Education Reforms.

According to the Bill, students aggrieved by the exam cancellations have a 30-day window after the release of results to appeal the decision. Notably, the Bill states, “A candidate whose examination results have been cancelled may apply to the Council within thirty days after the release of the results for a review of the Council’s decision.”

In contrast to the previous practice, where students had to resort to the judicial system for redress, KNEC will now accept written appeals from affected candidates. Applicants must explicitly state the reasons for seeking a review.

Upon receiving an application, the Council is mandated to consider and respond in writing within thirty days, providing an explanation if the request is denied. The Bill emphasizes transparency by ensuring that students are informed of the reasons for rejecting their review requests.

In the event of a successful review application, the student will be notified of the decision in writing. Furthermore, KNEC proposes that successful applicants appear before the council within 90 days, where, if satisfied that the candidate was not involved in any exam irregularities, the Council will release the results to the candidate.

Currently undergoing public participation, the Bill is poised to be presented to Parliament for debate. This development signifies a significant shift in the appeals process for students facing exam cancellations in Kenya.
