Court to Issue Directions Today on CBC Implementation Case

Today, a three-judge bench is set to issue directions in the case challenging the implementation of the Kenya Competence-Based Curriculum (CBC), where advocate Nelson Havi contests its constitutionality and lawfulness.

The matter, initially brought forth in 2021 by Esther Ang’awa, a high court advocate, saw her withdrawal from the case, citing alleged profiling by the state. Subsequently, Nelson Havi’s name replaced hers as the petitioner, with corresponding amendments made to the court documents.

Scheduled for 10:30 am today, Justices Hedwig Ongundi, Antony Mrima, and Antony Ndung’u will preside over the proceedings. The national rollout of the Competency-Based Curriculum commenced in January 2019, starting with Pre-Primary I and II and Grades 1, 2, and 3 in lower primary.

Introduced as a transformative shift from the 8-4-4 system, the 2-6-3-3-3 curriculum aims to address deficiencies identified in the previous rote learning approach.

Criticism has been directed at the government for its alleged failure to substantiate the initiation and execution of research informing the national adoption of the CBC curriculum. Critics argue that this lack of evidence raises questions about the curriculum’s foundation and implementation.

In a separate development, an anti-corruption court is poised to address a case involving the Ethics and Anti-Corruption Commission (EACC) obtaining orders to freeze assets belonging to former Muranga governor Mwangi Wa Iria.

The freeze order, valued at Sh543 million, is part of an investigation into a tender probe. The EACC contends that Wa Iria influenced the awarding of tenders worth Sh543 million in favor of a company associated with his close allies. The court is expected to mention this case in due course.
